Both male and female employees are protected by anti-gender discrimination laws. Employer practices that flow from stereotypes of gender roles or capabilities are prohibited. For example, women must be considered for job positions that men have typically held. Pregnancy as a source of discrimination against female workers is prohibited, as are all forms of sex-discrimination.

Here are some examples of gender discrimination:

  • An employer pays lower compensation or fewer benefits to female employees than males.
  • An employer demotes or terminates a female employee even though the employee functions as well or better than men in the same position.
  • An employer provides better benefits to male employees than female workers.
  • An employer promotes the career advancement of one gender of employees over another.
  • An employer discriminates against one gender in hiring policies.

The Equal Employment Opportunity Commission enforces federal discrimination laws in the areas of gender. Gender discrimination is a source of increasing employee lawsuits against employers. Women continue to earn less than men for a comparable job. In just the two years between 2003 and 2005, gender lawsuits increased 10 percent. The National Women’s Law Center reported that as of 2008, women earned only 77 cents for every dollar earned by men for comparable jobs. In 2009, a new law was passed allowing women more time to file gender-based discrimination lawsuits.
