National Origin Discrimination
The laws in the US prevent employers from discriminating against current employees or job applicants because of their national origin. US citizens and naturalized citizens, permanent and temporary residents, as well as refugees and those with asylum grants are protected. These employees are protected from discriminatory employment practices that are based on their birthplace, ancestry, speech accents, or culture. Employers may not base their decisions to promote, layoff, train, provide benefits or pay, hire, or terminate employees based on these factors.
Harassment in the workplace based on national origin is prohibited, such as: offensive comments, jokes, or speech. If minor instances of these types of harassment occur persistently, they may constitute a hostile work environment which is prohibited by US laws.
Employees married to or have relationships with non-American persons with a foreign unfamiliar national origin are protected against employer discrimination. Examples of prohibited national origin employer discrimination are:
- A person receiving a demotion, termination, or being denied compensation because of their national origin, or the national origin of an associate.
- A person who dresses or associates with persons of a different ethnicity, and receives unfavorable or less favorable employer treatment.
- A person who is not allowed to do work that other employees are assigned to because of their national origin.
- A person who experiences jokes or derisive comments in the workplace on the basis of their national origin.
- A person who is denied employment on the basis of national origin.
- A person who works for an employer who has a workplace rule for “English Only” and receives unfavorable employer treatment as a result.
