Your Rights

Under Minnesota law, there are statutes in place to assist you in recovering unpaid commissions.  Independent contractor sales representatives, who are paid on a commission basis, also have rights whereby they are entitled to the commissions earned prior to the termination of the independent contractor relationship. If you have not yet done so, you should make a written demand to your employee for these unpaid commissions. Under Minnesota law, a worker has a legal right to recover these unpaid commissions, plus penalties, attorney’s fees, and costs. See Minn. Stat. sec. 181.171. Specific types of independent contractor sales representatives are additionally covered via a different statute known as the Minnesota Termination of Sales Representatives Act.
