The EB 1-2 visa provides outstanding professors and researchers the opportunity to obtain permanent residency status in the United States. This visa is exempt from the PERM requirements. To qualify as outstanding, a researcher or professor must demonstrate international recognition in an academic field, and must also confirm other requirements including three years of teaching or research experience in the designated field. There are other requirements as well. The applicant must take a tenured (or tenured-track) position at a university or institution of high learning in the U.S.

A visa EB1-2 applicant can qualify by having a private employer who has a minimum of three persons engaged in research and who have documented accomplishments in an academic field offer employment.

In addition an EB 1-2 visa applicant must confirm with documentation at least two of the following:

  • The alien applicant has received major awards/prizes in recognition of outstanding achievement in the designated academic field.
  • The alien applicant has membership in academic associations which require outstanding achievements for membership.
  • The alien applicant has been the subject of published articles written by peers, and can provide confirmation with title, date, author, and translation as necessary.
  • Evidence that the alien applicant has participated as a judge of peers in the same or allied academic field.
  • Evidence that the alien applicant has contributed original scholarly research or scientific contributions in the designated academic field; or
  • Confirmation that the alien applicant has authored books or articles in scholarly journals in the academic field with international circulation.
