Once you have received your H-1B visa, it is important that you be aware of what duration of this status is. The duration of an H-1B visa is three years, as the three year point approaches, you are able to apply for an extension of up to an additional three years. People of H-1B status are able to change employers by simply submitting a new petition to the United States Citizenship and Immigration Services, a change of employer does not extend the maximum six-year period.

Although rare, there is an exception to this six-year duration sometimes made, if the person has experienced delays in the adjustment to their status due to backlogs in their category, or those who have experienced lengthy delays in the adjudication process of their application for their employment-based visa, or labor certification.
